Trade Agreements Act (TAA)
Selling to the federal government comes with its own rulebook. One of the most important chapters is the Trade Agreements Act (TAA). It controls where products bought under many federal contracts can come from.
Understanding what TAA-compliant means is vital. A single non-compliant cable can put an entire order at risk for agencies and resellers. TS Cables offers TAA-compliant cabling and connectivity products. We ensure that you meet these sourcing rules.
What Is the Trade Agreements Act?
Congress passed the Trade Agreements Act in 1979. It puts several international trade deals into U.S. law.
Under the TAA, federal agencies may only buy covered products from the United States or from a "designated country." The rule appears in federal contracts through FAR clause 52.225-5. It applies to all GSA Schedule contracts unless the solicitation says otherwise. It also covers many other federal purchases above set dollar thresholds.
Which Countries Qualify?
The countries designated are grouped together in a few categories. They encompass members of the World Trade Organization Government Procurement Agreement, U.S. free trade agreement partners, least developed countries, and certain Caribbean Basin countries.
The requirements are that you must be a Canadian, Mexican, Japanese, South Korean, Taiwanese, or be a member of the European Union. Some big countries in manufacturing are not. Not designated countries: China, India, Malaysia, and Indonesia.
Products manufactured there cannot be sold pursuant to a contract that is subject to TAA even if they are less expensive or more readily available. The official list is updated periodically. That is why it's a good idea to verify the up-to-date list before each bid.
How Country of Origin Is Decided
Origin isn't always as simple as reading a label. The TAA uses a test called "substantial transformation."
Wholly Made Products
A product grown, produced, or manufactured entirely in the U.S. or a designated country meets the rule. This is the cleanest path and the easiest to document.
Substantially Transformed Products
Many products use parts from several countries. In that case, origin goes to the country where the product became a new and different item. The new item must have a new name, character, or use. Simple assembly or repackaging usually isn't enough to change origin. For fully domestic sourcing, our Made in USA cables are the simplest path. U.S. Customs and Border Protection makes formal rulings when the answer isn't clear.
Why TAA Compliance Matters
It's a serious situation for those who sell to the federal buyer. If a product is not compliant, it may result in the order not being placed, contract cancellation, or removal of the product from the GSA Advantage. The False Claims Act may result in penalties for serious cases. It is crucial to be aware of TAA compliance and the importance of learning more about these risks.
Contractors have an ongoing obligation too. They must keep product origin details accurate for the full life of the contract. Factories move, and suppliers change. A cable that qualified last year may not qualify today. Regular checks protect your contract and your reputation. Many school and agency buyers also ask for RoHS compliance.
